The general terms and conditions of sale are agreed between MBA - Marketing e Brindes, Lda., headquartered at Rua Vilar do Senhor 493, 4455-213 Lavra, tax identification number 502 64 0421, telephone contact +351 229 982 500 (Call for the national fixed network), Share Capital of €500,000, registered in the C.R.C. do Porto under No. 49377/91, hereinafter referred to as "MBA" and between any individual, hereinafter referred to as "user", who wish to make a quote through this website or any of the MBA websites.

The navigation and use of this website is governed by these general conditions of use, excluding any conditions previously available on the website or by prior express and written agreement. The prices shown on the website are merely indicative and do not constitute a contractual proposal. No sales are made through this website, only budget requests that are not binding.

MBA reserves the right, absolute and not subject to justification, to modify at any time the information and commercial offer presented on: products, prices, promotions, conditions of use, among other information present on the website, without the need for any prior notice.

3 | Conditions of Use

The user undertakes to use this website in compliance with the provisions of the applicable legislation, refraining from using the website for activities contrary to the law, morals and good customs, or the rights and interests of third parties .


This website may have links to other websites, which may contain useful information for the user. These general conditions will not apply to third-party websites. As such, if the user visits another website, redirected from our website, he must read the conditions of use, privacy policy, among other information, present on the website he visits.

 

4 | Product Information

The photographs that illustrate the products are merely illustrative, do not enter into the contractual field and do not replace any commitment on the part of MBA. The reproduction of the colors of the products is the closest to reality. On the other hand, with regard to technical data sheets and product descriptions from our partners or suppliers, MBA declines all responsibility for the validity of their content.

Some products may have incorrect specifications or prices, which is why MBA checks prices whenever it processes quotes and sends the amended quote for user approval, the order becomes effective after confirmation in writing by the of the user.

The user must check in the details of the product that he wants to budget if there is stock to carry out the budget. The existence of the product in stock is only ensured after MBA receives the request for a quote and confirms the existence of stock with the supplier.

To have in count:

› The quote will be canceled if payment is not made within 30 (thirty) working days;

› Estimates made during the weekend and holidays (national and local) will only be processed on the next business day.

5 | Pricing Information

The prices indicated on the website are merely indicative and do not constitute a contractual proposal, they are presented in Euros and the currency changes automatically depending on the user's country.

The price per unit of each type of product without VAT is shown, adding the VAT rate in force by law; the price per unit of each type of product with VAT included (excluding products with price subject to consultation).

In the case of sales to companies based in other countries, for more information send us an email or contact your manager.

Prices, images and specifications of products and services are subject to change without notice.

The MBA declines any responsibility for any publication or spelling errors on the website. When processing your budget and order, any and all pricing errors that may be displayed on the website due to technical anomalies will be detected and the user will be duly contacted and informed. If the price of the product or service shown on the website is actually lower, the difference will be refunded. If the price is higher, the user can accept or cancel the quote and order.

 

6 | Availability of Products and Services

In the event of a stock outage of the quoted item, the user will be notified of the estimated delivery period, and the order will only proceed after consent given by the user.

In case of unavailability, MBA can supply a good or provide a service to the consumer of equivalent quality and price, provided that this possibility has been foreseen before the conclusion of the order or in the order itself, in a clear and understandable way.

In case of absolute unavailability or discontinuation (stop being manufactured) of the ordered product, the user will be notified in order to enable its replacement by another product and the order will only proceed after consent given by the user. As there is usually a price difference, you should choose an item of approximate value, if the value is higher we will have to wait for the transfer of that difference.

In the event of absolute unavailability or discontinuation and if you do not wish to replace it with another product, the user may request a refund of the amount paid for the unavailable product.

The items available on the website have limited stock so they may become unavailable without prior notice.

 

7 | How to make Budgets?

Browsing the online catalogue, you can request a quote, to do so, you must enter your contact details in the case of a quick quote request (only 1 product) or make a complete quote request (possibility to quote 1 or several products), to do so, add the products you want to the shopping cart and enter your account details (it is necessary to register on the website). You can also change the quantity you want to purchase, recalculate the total value or add the product to your recommended list (registered users) to later view or quote. You must follow all the steps of the budget so that it is successfully finalized.

To make a budget, we put at your disposal three means:

When finalizing a quote, you will receive, by email, the information regarding the order, you can consult all the quotes in your personal area and a notification is sent to your manager who will follow up on it to check if you want to place an order. If the data is not correct, you can request its alteration and rectification according to the specifications you want and which are not implicit in the quote, from 1-color printing, 2-color printing, four-color printing, among other forms of personalization.

Orders are placed after approval of budgets by the user, through distance communication techniques, using any means that, without the physical and simultaneous presence of the supplier and the consumer, can be used with a view to the celebration of the contract between the said parties.

 

8 | Reserved Area

Any user can register on our website to gain access to their reserved area where they can access and change their data, carry out and consult the budget history and create a list of favorites.

If the user forgets the password he uses to log in, he can request that a new password be sent to his email address. To do so, click here and you will receive a notification with a new password that you must change the first time you access your reserved area.

 

9 | Budgets through the Simulator

Use the simulator to get an approximate idea of the value of the product with printing. The value shown in the simulator is merely indicative due to the wide variety of materials and printing techniques. After completing the online purchase, you will be contacted by an account to confirm product stock, location, technique and printing value. To speed up the process, send the artwork and order number to [email protected].

The textile includes a 1 color print (stamping) or digital transfer up to 100cm2. In the remaining products a laser engraving (wood or metal) or a UV digital print up to 10cm2

The value for transport is free for orders equal to or greater than €150 + VAT (€184.5 inc. IVA) with delivery in mainland Portugal.

10 | Payment Methods

For your convenience, we provide several payment options. You can pay for your order securely using an ATM Reference, MB Way, VISA/MasterCard Credit Card, Bank Transfer or Meo Wallet Balance. See here all the details and go to www.nobrinde.com/pagamentos to pay for your order.

MBA authorizes MEO Wallet to intermediate payments made by the user.

 

11 | Delivery of Parcels

All orders are delivered to the address indicated by the user. Orders are delivered through a transport company contracted by MBA or the user can pick up the order at the MBA Headquarters in Lavra.

With delivery via a carrier, it is possible to track your orders via the Internet. The guarantee of shipment of orders will only be ensured upon and after confirmation of payment, regardless of the payment method.

As soon as you receive confirmation by email that your order has been dispatched, it must be delivered within 48 hours (mainland Portugal). If this does not happen, you should immediately communicate with our user support services. Deliveries by courier are only made to addresses where there is a guarantee that someone will be there to receive the order, otherwise it will be returned at the user's cost. Orders are only shipped after payment confirmation.

MBA cannot be held responsible, in any way, for any damages, direct or indirect, arising from delays in deliveries or the unavailability of the ordered product.

 

12 | Transport

The user, when awarding a quote, and if the products are in stock, they will be sent after payment to the address provided in the registration, by email or telephone, and the expected delivery time and transport cost will be indicated (if applicable). applicable).

For orders under €150 +VAT (€184.5 VAT included), and for mainland Portugal, delivery fees (postage) are borne by the user, and in the case of orders over €150 +VAT ( €184.5 including VAT), delivery costs to mainland Portugal are free. Delivery is free in Spain and France on orders over €300 +VAT. This rule does not apply to resale or to the islands of Portugal, Spain and France, always having an associated delivery cost.

For deliveries of orders in the Islands and in other countries, shipping costs are subject to consultation, are calculated before the formal adjudication, and will be analyzed on a case-by-case basis depending on their weight, volume and destination. For deliveries to other countries, the user may be subject to customs fees in force in the country.


Mainland Portugal:

› Orders up to €150 +VAT (€184.5 VAT included) have an extra €10 +VAT (€12.3 VAT included);

› Orders sent on collection will be charged €10 + VAT (€12.3 VAT included).


Spain and France:

› Orders up to €300 +VAT the price and transit time will be indicated for each case;


Islands (Portugal, Spain and France):

› Price and transit time will be indicated for each case;

› Shipping on charge is higher than the normal delivery cost.


Resale and Orders to other Countries:

› Resale and delivery in other countries has an increase in the value of transporting the goods, regardless of the value of the order;

› Price and transit time will be indicated for each case.

 

13 | Billing

The invoice is issued and printed on letterhead when the order is completed and is delivered together with the order. The user can choose whether he wants an invoice or a simplified invoice.


14 | Complaints

If the user wishes to submit a complaint or request for information, he may contact MBA directly by registered letter to the above address or email [email protected] to be able to resolve the object of the complaint as soon as possible. MBA undertakes to provide a response within a maximum period of 15 working days from the date of receipt of the complaint.

15 | Warranty

Products marketed by MBA are covered by the legal guarantee regime, excluding customized products.

In the case of a damaged product, with a manufacturing defect or if it presents anomalies due to damage caused by transport, the user must send an email to the company within 15 days after receiving the products and without having made any use of the with as much information as possible, you can also attach photographs to illustrate the breakdown or damage.

The product will be promptly replaced or the purchase price returned within a maximum period of 30 days from the date of knowledge of the anomaly. Products that include software must be returned with undamaged packaging.

 

16 | Responsibility

Browsing and using this website is at the sole risk of the user. To the maximum extent permitted by applicable law, MBA will not be liable to any user for any loss, damage, cost or expense incurred as a result of using the contents of this website.

MBA is not responsible for damages arising from any computer virus or other situations that prevent access and correct functioning of navigation and the functionalities of the website and services made available therein.

MBA declines any responsibility in case of violation of the legislation of the country where the order is delivered, the user must check the conditions of import and use of the products he intends to order.

 

17 | Applicable Law

The present general conditions, information present on this website and all contracts that may be concluded under the same are governed by Portuguese law.

 

18 | RAL - Alternative Dispute Resolution

Alternative Dispute Resolution encompasses mediation, conciliation and arbitration. Allows the user to resort to official entities to help resolve or guide a conflict before opening a litigious case in a Court.
